Legality of sports betting
The legality of sports betting has received renewed attention after the Supreme Court decision in Murphy v. NCAA, which fundamentally changed the industry. The court ruled that the Professional and Amateur Sports Protection Act, which had prohibited full-scale sports betting in every state except Nevada, was unconstitutional. By a 6-3 vote, the court overturned the ban on sports betting, allowing it to continue in all other states.
While sports betting is still illegal in most states, New Jersey is trying to legalize it. The state argues that it is a matter of states’ rights. It also says that Congress could have passed a federal law outlawing sports betting, but that it can’t tell states that they cannot legalize it. The Supreme Court is expected to rule on the case within the next few months, and during oral arguments the Justices appeared to be sympathetic to New Jersey.
Sports betting has a long and complicated history. The first state to legalize sports betting is West Virginia. The state’s lottery commission director was removed from his position as director following a Supreme Court decision in June 2018. The new lottery director, however, replaced the lottery director. West Virginia’s sports betting legislation is in effect in only one location, Hollywood Casino in Schenectady.
